Peru Court Orders Legal Recognition of Same-sex Couples

A elevated court in Peru ordered same-sex marriages to be legally registered in general records.

According to Reuters, the ruling comes after a gay Peruvian citizen sued the registration office for refusing to record her marriage overseas, citing that her constitutional rights were violated.

The Superior Court of Justice of Lima announced on Twitter that the Peruvian court ordered the records' office to "proceed with the registration" of the woman's marriage.

Although it is not illegal to be gay in Peru, they are one of the few Latin American countries that has not recognized same-sex marriage, even though a survey initiate that 68% of Peruvian people were in favor of same-sex marriage.

    Peru is one of the few countries in South America that do not legally recognize same-sex couples. Trans people can go to court to rectify the name and gender marker on their national culture card, but the process is expensive, complicated, and can receive many years. Trans people's organizations have been fighting since to enact a law that allows this change to be made administratively, but these efforts possess been blocked by conservative majorities in the legislature. Since , Peru has had a commandment explicitly banning discrimination based on sexual orientation and gender self, but violence and discrimination against LGBTIQ people remain, and cases of hate crimes often move unpunished. In April , the Inter-American Court of Human Rights upheld a gay man’s rights to judicial protection and legal equality after he was subjected to discrimination at a business establishment. In , the Ministry of Health unexpectedly issued a decree classifying being transgender as a mental health disorder, a move that sparked widespread criticism from LGBTIQ activists and human rights organizations.
